In particular, the aspects regarding the minors are picked up in article 8 of Regulation (the EU) 2016/679 of the European Parliament and the Council.

Conditions applicable to the consent of the boy in relation to the services of the society of the information

  1. Between 16 and 13 years

    When article 6 is applied, separated 1, letter a), in relation to the direct supply to children of services of the society of the information, the treatment of the personal data of a boy will be considered allowed when it is as minimum 16 years old. If the boy is smaller of 16 years, such treatment will only be considered allowed if the consent gave it or authorized the holder of the parental authority or trusteeship on the boy, and only insofar as it occurred or it authorized.   2.  To verify consent

    The person in charge of the treatment will deliver reasonable attacks to verify in such cases that the consent was given or authorized by the holder of the parental authority or trusteeship on the boy, considering the technology available.

  3. General dispositions

    Section 1 will not affect to the general dispositions of the contractual Right of the Member States, as the norms regarding the validity, formation or effects of contracts in relation to a boy.
